Our standard flat fee is just $1,995 attorney's fee plus court filing fee and newspaper publication fee for a total of $2,175 for uncontested probate cases. Our flat fee rate is is an excellent value for an uncontested probate. There is no hourly fee.
Most probate attorneys in Idaho charge an hourly rate for probate and the average rate ranges from $225 to $400 per hour. Total probate costs for uncontested cases often run from $2,800 to $5,000 plus court filing fees and other costs.
Ocassionally there can be other minor charges such as the newspaper publication cost which is approximately $70 and other minor charges such as deed recording fees, etc. If a case becomes contested, with disputes between heirs or creditors, then it generally requires more court hearings and much more work so it becomes more costly and usually switches to an hourly rate with credit for money already paid.
