Small Estate Affidavit
The Idaho Estate Laws provide a procedure for a surviving spouse or heir of a deceased person to collect personal property that belonged to the deceased person when the property is in the possession of some other person or entity. This does not apply to real estate.
The requirements are that the value of the property is less than $100,000 and that the person present a Small Estate Affidavit to the person or entity holding the property. The law authorizing the Small Estate Affidavit and the requirements for using it can be found in Idaho Code § 15-3-1201.
